The European Court of Human Rights ruled that an appellate court cannot overturn an acquittal without hearing the witness directly. The Supreme Court of Ukraine clarified that disagreement with witness statements does not provide grounds for re-examining witnesses in cassation.

The European Court of Human Rights (ECHR) ruled that an appeals court cannot overturn an acquittal based solely on the testimony of a key witness without direct interrogation. The court referenced its own case law, including the case 'Chernika v. Ukraine'.
